This website is operated by Coastal Alchemy LLC. Throughout the site, the terms “we”, “us” and “our” refer to Coastal Alchemy LLC. Coastal Alchemy offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.  

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).  You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

MODIFICATIONS TO THE SERVICE AND PRICES. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

ERRORS, INACCURACIES AND OMISSIONS. Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

ACTIVITY. I KNOWINGLY, INTENTIONALLY AND VOLUNTARILY ASSUME ALL OF THE RISKS AND LIABILITY ARISING FROM OR BY PARTICIPATION in retreats and workshops (the “Activity”) offered by Coastal Alchemy LLC (the “Company”). As a precondition to participating in the Activity, I have read, understood, and agree to be bound by the following Release Agreement (the “Agreement”) and agree to its terms and conditions. If I don’t agree with this Agreement, or cannot comply with it, then I will not attend the Company Activity. 

In order to attend an Activity, you must be at least eighteen (18) years of age and able to enter into legally binding contracts. 

ASSUMPTION OF RISK. I recognize that the Activity may require physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved. I hereby elect to voluntarily participate in the Activity and assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me as a result of participating in the Activity whether caused by negligence or otherwise. 

COVID-19 WARNING: An inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. You assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting a communicable disease or illness—including, without limitation, exposure to COVID-19 or any other bacteria, virus, or other pathogen capable of causing a communicable disease or illness, whether that exposure occurs before, during, or after the event, and regardless of how caused or contracted—and you hereby waive any and all claims and potential claims against Universe, and against any companies affiliated with Universe—relating to such risks, hazards, and dangers.

LIABILITY RELEASE. In consideration for the Company allowing me to participate in the Activity, I knowingly, voluntarily, and expressly waive any and all liabilities, claims, demands, actions, causes of actions, costs, and expenses of any nature whatsoever I may have against Coastal Alchemy arising out of any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, arising from the Activity or while upon the premises where the Activity is being conducted, whether caused by negligence or otherwise. 

MEDIA RELEASE. Furthermore, I grant the Company, and its representatives, employees and agents the right to take photographs or video of me royalty-free in connection with any Company Activity for use in its publications, advertising, promotional purposes, website, social media, and/or visual presentations, unless I choose to opt out in writing prior to attending the Company Activity.

INDEMNIFICATION. I agree to indemnify and hold harmless the Company and its directors, employees, representatives, agents, sponsors and volunteers from and against any loss, liability, damage or costs, including court costs and attorneys’ fees, that the Company may incur arising from my involvement in the Activity whether caused by active or passive negligence of the releasees or otherwise.

WARRANTY OF FITNESS. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Activity. I represent and warrant that I have no physical or mental health condition that would prevent my safe participation in the Activity. I understand very clearly that these treatments and activities are not intended as a substitute for medical or psychological care. I understand that facilitators do not diagnose conditions, nor do they prescribe medicines, nor interfere with the treatment of a licensed medical professional. I maintain medical insurance that covers me for accidents and illnesses while I am participating in this Activity, or I am prepared to cover the cost of medical treatment for accidents and illnesses sustained during or as a result of my participation in this Activity. I understand the Company has not made, nor will make, any investigation into my physical or mental fitness or ability to participate in the Activity, and the Company is relying on my warranty of my physical condition. I assume full responsibility for payment of medical expenses not covered by my insurance incurred as a result of my participation in the Activity. 

INTENT. It is my express intent that this Agreement shall bind the members of my family and spouse (if any), my estate, heirs, administrators, assigns, and personal representatives. I agree that this Agreement and any claim arising from my participation in the Activity shall be construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provision. The courts in Sussex County shall be the forum for any lawsuits arising from the Activity or incident to this Agreement. The terms of this Agreement shall be severable, such that if a court of competent jurisdiction holds any term to be illegal or unenforceable, the validity of the remaining portions of shall not be affected thereby. 

UPDATING OF TERMS & CONDITIONS. You can review the most current version of the Terms of Service at any time on this page. The Company reserves the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
