PARTICIPATION TERMS FOR RETREATS AND WORKSHOPS

YOU KNOWINGLY, INTENTIONALLY AND VOLUNTARILY ASSUME ALL OF THE RISKS AND LIABILITY ARISING FROM OR BY PARTICIPATION in retreats and workshops (the “Activity”) offered by Coastal Alchemy LLC. As a precondition to participating in the Activity, you have read, understood, and agree to be bound by the following Release Agreement (the “Agreement”) and agree to its terms and conditions. If you don’t agree with this Agreement, or cannot comply with it, then you will not attend the Activity. 


  1. ELIGIBILITY. In order to attend an Activity, you must be at least eighteen (18) years of age and able to enter into legally binding contracts, or you have given us your consent to allow any of your minor dependents to participate in the Activity. By registering, you confirm that you meet the eligibility requirements.
  2. REGISTRATION AND PAYMENT. A completed registration form and payment are required to secure your spot. Payment terms, including deadlines and accepted methods, will be outlined at the time of booking. Refunds will only be issued per our cancellation policy, which will be provided during the registration process. We reserve the right to cancel events and will provide full refunds in such cases.
  3. ASSUMPTION OF RISK. By participating in our retreats or workshops, you acknowledge that the Activity may involve certain risks, including but not limited to physical injury, travel-related issues, or unforeseen circumstances, and you are fully aware of the risks and hazards involved. You elect to voluntarily participate in the Activity and assume full responsibility for any risks of loss, property damage, or personal injury that may be sustained by you as a result of participating in the Activity whether caused by negligence or otherwise. 
  4. CODE OF CONDUCT. Participants are expected to act respectfully toward others and follow the instructions provided by Activity organizers. We reserve the right to remove individuals who disrupt the experience for others without issuing refunds.
  5. COVID-19 WARNING. An inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. You assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting a communicable disease or illness—including, without limitation, exposure to COVID-19 or any other bacteria, virus, or other pathogen capable of causing a communicable disease or illness, whether that exposure occurs before, during, or after the event, and regardless of how caused or contracted—and you hereby waive any and all claims and potential claims against us, and against any companies affiliated with us—relating to such risks, hazards, and dangers.
  6. WARRANTY OF FITNESS. It is your responsibility to consult with a physician prior to participation and to ensure you have no physical or mental health conditions that would prevent your safe participation in the Activity. Participants assume full responsibility for assessing whether the activities are appropriate for them. The activities offered are not a substitute for medical or psychological care, and you understand that facilitators do not diagnose conditions, prescribe medications, or interfere with treatments by licensed professionals. You warrant your physical and mental fitness to participate and assume full responsibility for any health-related issues, including allergic reactions, that may arise. We will not assess your fitness to participate and rely solely on your representation of your condition. You assume full responsibility for payment of medical expenses and maintain medical insurance that covers you for accidents and illnesses while you are participating in this Activity, or you are prepared to cover the cost of medical treatment not covered by your insurance incurred as a result of your participation in the Activity.
  7. LIABILITY RELEASE. In consideration for us allowing you to participate in the Activity, you knowingly, voluntarily, and expressly waive any and all liabilities, claims, demands, actions, causes of actions, costs, and expenses of any nature whatsoever you may have against us arising out of any loss, damage, or injury, including death, that may be sustained by you or to any property belonging to you, arising from the Activity or while upon the premises where the Activity is being conducted, whether caused by negligence or otherwise. 
  8. MEDIA RELEASE. By participating in the Activity, you grant us, and our representatives, employees and agents permission to take photographs or video of you, royalty-free, in connection with the Activity for use in its publications, advertising, promotional purposes, website, social media, and/or visual presentations, unless you choose to opt out in writing prior to attending the Activity.
  9. INDEMNIFICATION. You agree to indemnify and hold harmless Coastal Alchemy LLC and its directors, employees, representatives, agents, sponsors and volunteers from and against any loss, liability, damage or costs, including court costs and attorneys’ fees, that we may incur arising from your involvement in the Activity whether caused by active or passive negligence of the releasees or otherwise.
  10. FORCE MAJEURE. We are not liable for cancellations or rescheduling due to events beyond our control, such as natural disasters, pandemics, or government restrictions.
  11. INTENT. It is your express intent that this Agreement shall bind the members of your family and spouse (if any), my estate, heirs, administrators, assigns, and personal representatives. You agree that this Agreement and any claim arising from my participation in the Activity shall be construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provision. The courts in Sussex County shall be the forum for any lawsuits arising from the Activity or incident to this Agreement. 
  12. SEVERABILITY. The terms of this Agreement shall be severable, such that if a court of competent jurisdiction holds any term to be illegal or unenforceable, the validity of the remaining portions of shall not be affected thereby.
